These Terms of Service ("Terms") apply to your use of adikumbh.com (the "Website") and to any purchase, pre-booking, custom commission or corporate order you place with AdiKumbh Studio, Pimpri-Chinchwad, Pune, Maharashtra, India ("AdiKumbh Studio", "we", "us" or "our"). By using the Website or placing an order with us, you agree to these Terms. If you do not agree, please do not use the Website or place an order.

1. Our products

Our pieces are designed in our studio and finished by hand. The materials and methods used for each piece are stated on its product page. For example, some statues are 3D printed in PLA (a plant-based polymer) and then hand-painted.

Because every piece is individually made and finished by hand, small variations in colour, paint, texture, surface layer lines and finish are a natural part of its character and are not defects. Product photographs are representative; colours may look slightly different depending on your screen and lighting. Dimensions and weights are approximate.

Our products are decorative items. They are not toys and are not intended for children.

2. Purchases on Amazon.in

Some of our products are sold through Amazon.in. When you buy on Amazon.in, your order, payment, delivery, returns, replacements and refunds are handled under Amazon.in's own terms and policies, which apply in addition to these Terms. Prices and offers on Amazon.in may change and may differ from any information shown on this Website; the price shown on Amazon.in at checkout applies.

For help with an Amazon.in order, please contact Amazon.in customer service first. You are also welcome to contact us using the details in section 16.

3. Pre-bookings and direct orders

For products marked as available for pre-booking or direct order on this Website:

• Submitting a reservation form is a request to reserve a piece. It is not a binding order until we confirm it in writing and you complete payment through the payment link we send you.
• We may decline or cancel a reservation, for example if a piece is no longer available or a pricing error has occurred. If you have already paid, we will refund the amount paid in full.
• Lead times shown on the Website are estimates. We will tell you promptly if a piece will take longer than expected.
• You may cancel a confirmed order before it is dispatched by contacting us. Ready-made pieces cancelled before dispatch will be refunded in full.

4. Custom commissions

For bespoke and personalised pieces:

• We will share a written quote describing the design, materials, size, price, timeline and any advance payment required. The commission begins once you accept the quote and pay any advance.
• Where a design proof, sketch or sample is shared, production proceeds once you approve it. Changes requested after approval may affect the price and timeline.
• Because commissioned pieces are made to your specification, they cannot be cancelled for a refund once production has started, except where the piece is defective or materially different from the approved design. Any advance paid before production starts will be refunded if you cancel at that stage, less any costs already incurred and agreed with you.
• You confirm that any names, logos, images or other material you ask us to include belong to you or that you have permission to use them.

5. Corporate and bulk orders

Corporate gifting, awards and bulk orders are quoted individually. Quantities, pricing, branding, packaging, delivery schedule and payment terms will be set out in the written quote or agreement for that order, which will take precedence over these Terms where they differ.

6. Prices and payment

Prices on this Website are shown in Indian Rupees (INR). Applicable taxes and any shipping charges will be shown in your quote or payment request before you pay. Payment for direct orders and commissions is made through the secure payment link or method we provide. We do not store your card or banking details.

7. Delivery

We currently deliver within India. Delivery timelines are estimates and may be affected by courier delays, holidays or events outside our control. Pieces are packed carefully to travel safely. Responsibility for the piece passes to you on delivery. Please check your parcel on arrival.

8. Damage, returns and refunds (direct orders)

• If a piece arrives damaged or is not what you ordered, please contact us within 48 hours of delivery with your order details and clear photos of the piece and packaging (an unboxing video is very helpful). We will offer a repair, replacement or refund.
• Because our pieces are handmade, we do not accept returns of undamaged ready-made pieces for change of mind unless required by law. Personalised and commissioned pieces cannot be returned unless defective.
• Approved refunds are made to the original payment method within 7 to 10 working days of approval.

Nothing in these Terms limits your rights as a consumer under the Consumer Protection Act, 2019 and the rules made under it.

9. Care and safe use

Please follow the care instructions on each product page. In general: dust gently with a soft, dry brush or cloth; keep pieces away from water, solvents, direct sunlight and high heat (for example, inside a parked car); and place them on a stable surface out of reach of small children and pets. We are not responsible for damage caused by misuse, accidents, or failure to follow care instructions.

10. Intellectual property

All designs, sculptures, product photographs, videos, text, logos and other content on this Website are owned by or licensed to AdiKumbh Studio and are protected by intellectual property laws. Buying a piece gives you ownership of that physical piece only. It does not give you the right to copy, reproduce, 3D scan, print, cast or sell copies of the design, or to use our photographs or branding, without our written permission.

Unless agreed otherwise in writing, we keep the design rights in commissioned pieces and may show photographs of them in our portfolio and on social media. If you prefer that we do not, just tell us when you place the commission.

11. Use of the Website

You agree to use the Website lawfully and not to interfere with its operation, attempt unauthorised access, or submit false, misleading or harmful information through our forms. Links to third-party websites (such as Amazon.in or Instagram) are provided for convenience; we are not responsible for their content or practices.

12. Limitation of liability

To the extent permitted by law, AdiKumbh Studio is not liable for indirect or consequential losses, or for delays or failures caused by events outside our reasonable control (including courier delays, natural events or service outages). Our total liability for any order is limited to the amount you paid for that order. This does not limit any liability that cannot be limited under Indian law.

13. Privacy

We handle your personal information as described in our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. The Terms in force when you place an order apply to that order.

15. Governing law and disputes

These Terms are governed by the laws of India. We will always try to resolve concerns with you directly first. Subject to your rights under consumer protection law, the courts at Pune, Maharashtra will have jurisdiction over any dispute.

16. Contact and grievances

For questions, order support or complaints, please contact us. We will acknowledge your message within 48 hours and aim to resolve it within one month.
